Acceptance of Terms

By accessing or using any service provided by Omega Digital (PIB 115602854, MB 68491495) ("Omega Digital", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use our services. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will make reasonable efforts to notify registered customers of material changes via email.

Description of Services

Omega Digital provides web hosting, virtual private servers, cloud compute, bare-metal servers, object storage, CDN, DNS management, and related infrastructure services (collectively, the "Services"). Services are provided on a subscription basis and are subject to the technical specifications described in the applicable Service Order or product documentation.

Omega Digital may modify, suspend, or discontinue any Service at its discretion, with reasonable notice to affected customers except in cases required to prevent harm, security breaches, or legal liability.

Accounts

You must create an account to access most Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate, current, and complete information during registration and keep your account information updated. Accounts may not be transferred or shared without prior written consent.

Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with our Acceptable Use Policy ("AUP"), which is incorporated into these Terms by reference. Prohibited activities include but are not limited to: distributing malware, operating spam infrastructure, hosting illegal content, conducting denial-of-service attacks, and violating third-party intellectual property rights.

Violations of the AUP may result in immediate suspension or termination of Services without refund.

Payment & Billing

Subscription fees are billed in advance for each billing cycle (monthly, annual, biennial, or triennial). All fees are stated in USD and are non-refundable except as expressly provided in these Terms or required by applicable law.

If payment fails, we may suspend your Services after a grace period of five (5) days. Accounts suspended for non-payment for more than thirty (30) days may be terminated and associated data may be deleted permanently. You are responsible for all applicable taxes.

Refunds and Cancellations

The following refund windows apply from the original order date. Refunds cover hosting fees paid for the current term; they do not include one-time setup fees (see below) or any third-party registry or SSL charges.

How to request a refund

Send a refund request to [email protected] and include: (1) your order number, (2) the reason for your request, and (3) whether you are requesting a full or partial refund. Approved refunds are processed as invoice reversals within ten (10) business days and returned to the original payment source.

Consumer law

These Terms are governed by the laws of the Republic of Serbia, including applicable consumer-protection legislation. Customers who are consumers resident in the European Union retain all rights granted under EU consumer law (including the 14-day cooling-off right for distance contracts) where such rights are stricter than, or in addition to, the terms above. Those rights are not affected or waived by this agreement.

Termination

You may terminate your account at any time through the control panel. Termination takes effect at the end of the current billing period, and no partial-period refunds are issued unless required by law.

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms, violate the AUP, or if we are required to do so by law. Upon termination, your right to use the Services ceases and we may delete your data after a thirty (30)-day grace period.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OMEGA DIGITAL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OMEGA DIGITAL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL OMEGA DIGITAL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Governing Law

These Terms shall be governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the competent courts of the Republic of Serbia, and you consent to personal jurisdiction in those courts.
