Overview

Omega Digital (PIB 115602854, MB 68491495) respects the intellectual property rights of others and expects our customers and users to do the same. This policy describes how rights holders can notify us of alleged copyright infringement on content hosted on our infrastructure, and how affected customers may submit a counter-notice.

Although Omega Digital is established in the Republic of Serbia, we voluntarily honor the notice-and-takedown procedure modeled on the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512) and equivalent EU provisions.

Submitting a Notice of Infringement

To submit a notice, send an email to [email protected] with the subject line "DMCA Notice" and include the following information:

  • Your full legal name, mailing address, telephone number, and email address.
  • Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works).
  • Identification of the allegedly infringing material, including the URL(s) or other information sufficient to locate it on Omega Digital infrastructure.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  • Your physical or electronic signature.

Incomplete notices may be rejected. Knowingly making a material misrepresentation in a notice may result in liability under applicable law.

Our Response

Upon receipt of a compliant notice, Omega Digital will promptly (typically within 24–72 hours) investigate and, where appropriate, remove or disable access to the allegedly infringing material. We will notify the affected customer of the action taken and provide them with a copy of the notice.

Counter-Notice

If you believe content you posted was removed or disabled in error, you may submit a counter-notice to [email protected] containing:

  • Your full legal name, address, phone number, and email.
  • Identification of the material removed and the location where it previously appeared.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • A statement consenting to the jurisdiction of the competent courts and that you will accept service of process from the original complainant.
  • Your physical or electronic signature.

If we receive a valid counter-notice, we may restore the removed material after 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.

Repeat Infringers

In accordance with our Acceptable Use Policy, Omega Digital will terminate the accounts of customers determined to be repeat infringers. What constitutes a "repeat infringer" is determined at our sole discretion considering the totality of circumstances.
